Filing Emergency Bankruptcy

Where circumstances require immediate filing so as to prevent a judicial sale or foreclosure of any property, or other type of emergency, an emergency bankruptcy filing of the uncompleted bankruptcy petition is allowed to be filed before the schedules are complete.

Also known as a face sheet bankruptcy filing, you can fill out the first eight pages of the voluntary petition B101 along with form B121 (SS# documentation) and the list of creditors to be notified of the automatic stay (creditor matrix). This will allow you to start your emergency bankruptcy very quickly.

You will then have 15 days to complete your bankruptcy schedules under protection of the automatic stay. Failure to file your supporting documents within the designated time may revoke your bankruptcy case number.

(note) Face sheet (emergency) bankruptcy filing paperwork requirements vary from court to court. Be sure and contact the court clerk regarding rules for the district you intend to file to check for any other emergency bankruptcy filing requirements.
